Acceptable Use Policy

Automatan, Inc. provides businesses with an AI-powered automation and workflow platform. Our customers rely on the Service to run critical parts of their operations. To ensure the Service remains reliable, secure, and trustworthy for everyone, all users must access and use the Service in ways that do not abuse or misuse it. Misuse includes but is not limited to the prohibited conduct set out in the sections below. This Acceptable Use Policy (AUP) sets out what we consider abuse of Service.

This AUP forms part of Automatan's Terms of Service and applies to all customers, Authorized Users, and end users accessing the Service through a customer's account. By using the Service, you agree to this AUP. Capitalized terms not defined here have the meanings given in the Terms of Service.

Responsible use is a shared priority. Our rules are no substitute for the legal requirements, professional obligations, and ethical standards that should guide how you use AI. We hold users accountable for misuse, and violations of this AUP may result in suspension, termination, or other enforcement action.


Definitions

"Automatan, Inc." means Automatan and its affiliated entities.

"Service" means the Automatan platform, including its AI-powered automation tools, APIs, software, models, and related products and services.

"Third Party" means any party other than Automatan and Customer, including customers' end users, integration partners, and application providers.


Security and Network Abuse

Don't access or use the Service in ways that create any of the following:

  • Disruption of availability: adversely impact the availability or performance of the Service or any third-party service.
  • Denial of service: create or facilitate denial-of-service or distributed denial-of-service attacks against the Service or any third-party system.
  • Bypassing security or safety controls: circumvent or attempt to circumvent usage limits, billing triggers, rate limits, authentication mechanisms, content moderation systems, or safety filters established by Automatan or any third party. This includes reverse-engineering to find limitations or vulnerabilities, jailbreaking models, prompt injection, or otherwise evading moderation safeguards.
  • Security risk: create a security or operational risk to Automatan, the Service, other customers, or any third party.
  • Malicious attacks: send, facilitate, or participate in cyberattacks of any kind against any system or infrastructure.
  • Unauthorized surveillance: create, distribute, or deploy spyware or any capability for covert surveillance, persistent tracking, or monitoring of a person or device without their valid consent or other legal right.
  • Malicious software: distribute, host, or facilitate the delivery of malware, ransomware, trojans, viruses, or other malicious code.

Harmful, Illegal, or Deceptive Use

Don't access or use the Service in ways that:

  • Violate applicable law: engage in or facilitate any activity that violates applicable laws or regulations, including export controls, sanctions laws, or use of the Service from a jurisdiction subject to comprehensive U.S. sanctions or by any person on a U.S. government restricted party list.
  • Promote violence or harm: threaten, incite, plan, or facilitate violent activities intended or likely to cause physical harm to people, animals, or property.
  • Exploit minors: exploit, endanger, or sexualize anyone under 18 years old in any way. This includes creation, distribution, or storage of child sexual abuse material (CSAM), grooming of minors, or exposing minors to harmful content. Automatan will report apparent CSAM to relevant authorities.
  • Harass or discriminate: harass, abuse, threaten, or discriminate against individuals or groups based on race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, age, disability, or immigration status.
  • Deceive or defraud: engage in fraud, scams, phishing, spoofing, impersonation, or other deceptive conduct. This includes misrepresenting AI-generated content as human-generated, creating fake accounts or fake engagement, or generating misleading reviews or endorsements.
  • Spread disinformation: create or distribute knowingly false or misleading content intended to harm, manipulate public opinion, interfere with democratic or electoral processes, suppress voter participation, or mislead about electoral outcomes.
  • Violate privacy: collect, process, or share personal data without lawful basis; conduct unlawful surveillance or profiling; use biometric identification, facial recognition, or emotion recognition without complying with applicable legal requirements; or synthesize a person's voice or likeness without their explicit consent. Processing of personal data through the Service is also governed by the Data Processing Addendum.
  • Infringe intellectual property: upload, process, or distribute content that infringes copyright, trademark, patent, or other intellectual property rights, or misappropriate trade secrets or confidential information belonging to third parties.
  • Develop weapons: produce, modify, design, develop, or facilitate the acquisition of weapons, explosives, dangerous materials, or systems designed to cause mass harm, including biological, chemical, nuclear, or radiological weapons.
  • Exploit or manipulate individuals: use subliminal, manipulative, or deceptive techniques that distort a person's decision-making; exploit vulnerabilities related to age, disability, or financial circumstances; or conduct social scoring or predictive profiling that leads to detrimental treatment of individuals.

AI-Specific Prohibitions

Don't access or use the Service in ways that:

  • Make high-risk automated decisions without human oversight: make fully automated consequential decisions affecting individuals' safety, rights, or well-being — including in employment, credit, insurance, housing, education, healthcare, law enforcement, immigration, or access to essential services — without appropriate human review where required by applicable law.
  • Generate harmful AI content: use the Service to generate content that harasses, defames, or targets specific individuals; create non-consensual intimate imagery or deepfakes; or produce synthetic media designed to deceive in ways that could cause harm.
  • Circumvent AI safeguards: participate in jailbreak campaigns, prompt injection attacks, or any other method intended to cause the Service or any third-party AI system to generate outputs that would otherwise be prohibited under this AUP.
  • Process sensitive data without authorization: submit health data, biometric data, financial account credentials, government identification numbers, or other sensitive personal data to the Service without a separate written agreement with Automatan expressly permitting such processing.
  • Automate abuse at scale: use the Service to generate or distribute spam, conduct automated social engineering, or otherwise abuse platform APIs in ways that degrade the Service for other users.

Platform Exploitation

Don't access or use the Service in ways that:

  • resell, sublicense, or otherwise commercially exploit access to the Service without Automatan's prior written authorization;
  • use the Service to develop, benchmark, or support a product or service that competes with the Service;
  • reverse engineer, decompile, or attempt to extract proprietary technology, model weights, prompts, or pipelines from the Service; or
  • create multiple accounts to circumvent plan limits, usage restrictions, or enforcement actions.

Enforcement

If you are using the Service in violation of this AUP, Automatan may investigate and take action. As every situation is unique, Automatan reviews violations on a case-by-case basis. In some cases Automatan may contact you and request that you address the violation. In others, Automatan may temporarily or permanently suspend or terminate your account, with or without notice, depending on the nature and severity of the violation. Violations involving child safety, security attacks, or circumvention of platform safeguards may result in immediate termination without prior notice or opportunity to cure.

Automatan may report suspected illegal activity to relevant authorities and cooperate with investigations consistent with applicable law. Enforcement actions under this AUP do not limit any other rights or remedies available to Automatan under the Terms of Service.

Customers who wish to dispute a suspension or enforcement action may contact Automatan at legal@automatan.ai. Automatan will review such requests in good faith and respond within a reasonable time.


Updates to this Policy

This AUP may change over time. When changes are made, the updated version will be posted on the Automatan website and the "Last Updated" date will be revised. Where changes are material, Automatan will provide at least thirty (30) days' notice by email to the address associated with Customer's account before the updated policy takes effect. Continued use of the Service after changes become effective constitutes acceptance of the updated policy.
